Abstract

Examines approaches to the study of labour law, comparing traditional with more market-focussed approaches, arguing that the idea of the labour constitution continues to offer a useful framework for scholarly analysis of the link between democracy and the protection of workers' interests. Several references to the Webbs' 'Industrial democracy' particularly in Chapter 2: Hugo Sinzheimer and the Economic Constitution: "Though it cannot perhaps be known for certain, it seems highly likely that Sinzheimer originally took the idea of industrial democracy from the Webbs. Their two volumes on Industrial Democracy were translated into German in 1898, and according to Kahn-Freund, Sinzheimer ‘must’ have read them."
